Important distinction
This website explains our services and allows people to contact us. It does not, by itself, create an employment relationship, staffing engagement, recruitment mandate, or guarantee of work or candidates.
1. About these terms
These Terms of Service apply to your access to and use of pncconsulting.com and to information you submit through the website or related initial communications. The website is operated by 15044529 CANADA INC. under the name People & Culture. Our Ontario temporary help agency licence is THA-0000010194 and our Ontario recruiter licence is REC-0000010319.
By using the website, you agree to these terms. If you do not agree, do not use the website. Separate signed agreements may apply to staffing, recruitment, consulting, employment, or assignment relationships. If a signed agreement conflicts with these website terms, the signed agreement governs the subject of that agreement.
2. General website information
Website content is provided for general information about People & Culture and its services. It is not legal, employment, tax, immigration, payroll, health and safety, or other professional advice. You should obtain advice appropriate to your circumstances when needed.
3. Employer inquiries and service engagements
An inquiry, meeting, proposal, estimate, or exchange of information does not create a staffing, recruitment, consulting, fiduciary, partnership, agency, or exclusive relationship. Services begin only when People & Culture and the relevant client enter into an authorized written agreement or other written confirmation that clearly establishes the engagement.
Role availability, candidate availability, timelines, rates, responsibilities, guarantees, replacement terms, payroll arrangements, workplace obligations, and other commercial terms are governed by the applicable client agreement.
4. Candidate submissions
You are responsible for ensuring that information you submit is accurate, current, and not misleading. Submitting a resume, application, screening response, form, or other information does not guarantee an interview, assignment, offer, or employment. Opportunities may change or close, and staffing decisions depend on role requirements, recruiter review, client needs, candidate availability, and other legitimate considerations.
Do not submit confidential information belonging to another person or organization unless you are authorized to do so. If you provide reference contact information, you represent that you are permitted to provide it for recruitment-related contact.
5. Screening and recruitment technology
Some roles may use structured phone screening, recording, transcription, question-and-answer organization, mobile forms, document collection, and other technology-supported steps. Relevant notices and consent requests may be provided at the point of collection. People & Culture recruiters review the available information and make decisions about who moves forward in our process. Employers make their own hiring decisions.
If you need an accommodation or have questions about a screening step, contact us before completing it so that we can discuss a reasonable alternative where available.
6. Communications
If you contact us, you authorize us to respond using the contact information you provide. You may ask us to stop optional communications. Service, assignment, safety, legal, or transactional communications may still be necessary where an active relationship exists.
7. Acceptable use
You must not:
- Use the website for an unlawful, fraudulent, discriminatory, harmful, or misleading purpose.
- Submit false information, impersonate another person, or misrepresent your authority.
- Attempt to gain unauthorized access to the website, systems, accounts, records, or communications.
- Introduce malicious code, overload the website, scrape it in a way that disrupts service, or interfere with security or operation.
- Copy, republish, sell, or exploit website content except as permitted by law or with our written permission.
- Use website content or contact information to send spam or other unauthorized communications.
8. Intellectual property
The website, design, branding, written content, graphics, workflows, and other materials made available by People & Culture are owned by us or used with permission and are protected by applicable intellectual property laws. We grant you a limited, revocable, non-exclusive right to access and use the website for legitimate personal or business evaluation of our services. No other licence is granted.
9. Third-party services and links
The website or our recruitment process may link to or use third-party services. We do not control third-party websites and are not responsible for their availability, content, security, or terms. Your use of a third-party service may be governed by that party's own terms and privacy policy.
10. Privacy
Our Privacy Policy explains how we collect, use, disclose, retain, and protect personal information. It forms part of these terms.
11. Website availability and changes
We may update, suspend, restrict, or discontinue any part of the website at any time. We aim to keep information useful and current, but we do not guarantee that the website will always be uninterrupted, secure, complete, or error-free.
12. Disclaimers
To the extent permitted by law, the website and its content are provided on an “as available” basis without representations, warranties, or conditions of any kind, whether express, implied, statutory, or collateral. This includes implied warranties or conditions of accuracy, merchantability, fitness for a particular purpose, non-infringement, availability, or results.
Nothing in these terms excludes a right or remedy that cannot lawfully be excluded.
13. Limitation of liability
To the extent permitted by law, People & Culture and its directors, officers, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, business, opportunity, or goodwill arising from use of or inability to use the website. Where liability cannot be excluded, it will be limited to the minimum extent permitted by applicable law.
14. Governing law
These terms are governed by the laws of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict-of-law rules. Subject to any mandatory rights, disputes relating to these terms or the website will be brought before the courts located in Ontario.
15. Severability and waiver
If any provision of these terms is found unenforceable, it will be limited or removed only to the extent necessary, and the remaining provisions will continue in effect. A failure to enforce a provision is not a waiver of that provision.
16. Updates
We may update these terms by posting a revised version with a new last-updated date. Your continued use of the website after an update means the revised terms apply to future use.
